Appellate Body COOL dispute

Last Friday, the Appellate Body of the WTO upheld most of the panel’s rulings and recommendations in the dispute (DS384 & DS386) filed against the US by Canada and Mexico.

Some of the core elements of the panel’s rulings and recommendations found the COOL measure inconsistent with the TBT agreement, as it did not fulfill its legitimate objective. The AB found that the COOL measure “lacks even-handedness” by imposing “a disproportionate burden on upstream producers and processors of livestock, as compared to the information conveyed to consumers through the mandatory labelling requirements for meat sold at the retail level.”
